My husband & I have been residing in a condo for almost 2 years and the upstairs toilet tank cracked while no one was home and flooded the downstairs ie through cieling. The owner replaced the toilet but told us that it was our fault and to move out(30 day notice) and refused to clean water up or fix anything else. We reported her to the health department upon which they deemed the dwelling uninhabitable, due to mold issues, and moved out before our thirty day notice was up. Now the owner is charging us to remodel the condo. Is this legal and what are our rights. Should I take her to small claims court. :confused:
