Term letter AND put on Leave w/o pay

As a federal employee, during initial probationary period, (in learning mode) I was handed a termination letter with the reason being poor performance-no forewarning. I've realized I'm receiving MyPay notifications and have been put in a leave without pay status (involuntary).

I filed an appeal with the MSPB board, even though I may not qualify for a hearing and received my performance reviews via "Discovery". All showed I met the required standards. There were a couple of negative statements about my performance by coworkers/OJT trainers included in the packet (These people are on too friendly terms with the boss).

There are a couple of questionable items (alterations) on one of the reviews even though the standards still show " met".

I have requested my personnel file (Privacy Act & FOIA), multiple times via registered mail, phone calls and receipted email; I've been ignored.

I've filed an EEOC formal complaint (ageism & racism).

I am not a union member although a union rep is assisting me.

The former boss has been removed from his supervisory position due to unprofessional behavior and a lack of integrity. He also has several other complaints and grievances against him.

Does anyone have advice on where I go from here in order to get back to work? I've sought legal advice but not too many attorneys deal with federal statutes.

Unemployment benefits while in an LWOP status. How might that work out?

Do I need to find an attorney in WA.?

Yes, you can file for unemployment. Whether or not you will be granted benefits is up to the state. Expect the employer to protest, however.
