terminated and holding last check

I was let go of my job for allegedly stealing 40$ on a Friday when I asked for my last check on Monday he told me I wasn't getting it until I paid back 82$ where he got that number I am not sure. I didn't steal anything and I need that money to live off of. Can he legally hold my check

No, he can't. Call the state Wage and Hour folk and file a complaint.
