Termination of "cash negligence" without proof

March 17th, 2010-My recent employer terminated me for what they are labeling as "Negligent Cash Management" that happened 2 days prior. I and a fellow co-worker were indirectly accused of theft. No exact total was given, nor proof offered. We were asked "what do you think happened" then let go.

I've been an outstanding employee, only once given a verbal for tardiness, my three month review I was given great marks and a raise. My employer has been robbed by outside intruder several times in the last month as well as the software in which they use to track financial has been known to glitch and be over or under by several hundreds of dollars, and as far as I know has never been investigated, and sometimes has a tendency to correct itself overtime.

I am curious where I stand with this company and my future reputation. I am an honest upstanding citizen. Do I have any legal recourse? Can I offer to take a polygraph to prove my innocence? How is "Negligent Cash Management" going to effect me with future employers or with unemployment benefits?

I really don't care to work for this company anymore, they are highly disorganized. But I would rather not have my reputation tarnished on what seems to be an uninvestigated claim. Especially since all recent cash transaction are not secured, as the company had been robbed of their cash drawers. Any cash transactions that occur are simply put in an envelope behind the desk in a very public and accessible area. How can they put all the blame on the last two who made the final count before putting in the designated location?

An employer may legally terminate an employee if they suspect deception in avoidance of a drug test. Even though they may be wrong or ignoring the truth for whatever reason, they may still terminate you.

Can I offer to take a polygraph to prove my innocence?
Again, as this is NOT a legal issue, only your company can say if this would be of benefit to them or not.

How is "Negligent Cash Management" going to effect me with future employers or with unemployment benefits?
It shouldn't affect you at all. Any future potential employers who calls for reference will probably only receive the information that 'yes you worked there and whether or not your are rehirable'. Any additional information would come from yourself. File for unemployment, it will be up to the unemployment office to determine your eligibility in the event the company denies your claim.

This has to do with company procedure and policy and is not regulated by law.

However, they CAN say anything to a prospective employer that is the truth or their honestly held opinion. Whether or not they WILL, we have no way of knowing.
