At a party, someone used my phone to text a friend on my contact list; and it was in drunken prank in jest to tease the mutual friend for not coming to the lake to party with the girls we were meeting.
TEXT MSG: "you're 2k short, make it right or we drop the girls off at the lake, you don't want trouble"
or along those lines. I'm not sure, i believe an inside joke between the two, but can see the implications if read by a stranger.
The text message went to someone else on accident, and that person texted back asking who I was and I said "I'm truly sorry about that, text msg was sent to wrong person on accident, it was just a prank to a friend."
But that person called the cops after and i believe the cops may be trying to make a case out of it. The officer called my phone the next day, and another person at the lake party answered, unsure who the officer was, or if it was a real officer; but they gave a false name, said they found the phone, and not sure who the owner is. Then hung up after the officer tried to get them to come in and bring the phone and was going to make a report that the phone was stolen. That person was an acquaintance at the party. And doesn't want to be involved, and I don't blame him.
My question: Can a case be brought against me for a pranked text that didn't outright threaten anyone? dropping the girls off at lake could mean absolutely anything. 2nd, am I liable for the lies of another while holding my phone. Should I be worried since the phone is under my name and i don't want it reported as stolen.
I have a criminal history in misdemeanors and don't want to talk to police about anything at any time; because they tend to bring more harm than good with me. What do you think the next step the police will take since someone else answered the phone and now the phone is turned off, but I won't claim it stolen to the service provider?
