Last night I was with my friend who is only 16, and we were smoking some marijuana. I was parked in a parking lot of a park. The cops suddenly appeared and we knew we were in trouble. I also had an open beer in my car. I took a breathalyzer and blew a .01. My friend also took one and blew .00. The officer's also searched my car leaving it a disaster area. All my belongings were everywhere. They proceeded to find my pipe and a little bit of marijuana. I was charged with possession of marijuana, less than an ounce, possession of drug paraphernalia, and an open container. When they were done searching, they called my friends mom. They then told me not to drive, and left us both at the park. I have a court date, and I'm also going to try and take diversion. I guess I'm just looking for some advice on what to do.

I would suggest getting a lawyer with three charges pending that you know of. Have you seen the charges? Did they add contributing to a minor or anything like that? Don't leave it up to chance. The thing at the house sounds like it may not come back to bite you as you didn't get a ticket or anything. Did they give you a written warning? Any way a lawyer will be able to sort it all out. In the mean time...stay away from people under 18 and if drinking stay away from people under 21. You'll have a record now and it will really hurt some of your chances at getting jobs (not all of them though so don't get too discouraged). I know at 22 you still feel like a kid but in the eyes of the law you're a grown up. So stop toking and start wising up on how NOT to ruin your life with adolescent behavior.

PS: In Texas, there is no expunging or sealing a record once convicted.
