Hi,
so i was caught stealing 6 dollars worth of merchandise at a department store and the police were called. i already attended the preliminary heard where, with the advice from an attorney who was there, i pleaded not guilty and got the number for a prosecutor. the attorney at the hearing (not MY attorney- i am representing myself) told me since it is my 1st offense i could make a plea bargain (but thats not what she called it) with the attorney and most likely keep it off my record. i forget what she called that-
Question 1:
WAS SHE REFERRING TO the DIVERSION PROGRAM?
also, i finally got a hold of the prosecutor and she was pretty scary. i told her what the attorney told me and she said that attorney doesnt make the decisions! ( which i know, but the attorney told me she knows the prosecutor does that all the time). the prosecutor asked if i have a public defender and when i told her i was representing myself she said "you are being charged with a VERY serious crime." and recommended i seek an attorney. she had actually not read through my file yet, so i am hoping when shes sees its my 1st offense and that it was only 6.00 she will take that into consideration.
Question 2: what do YOU think?
she told me shed get a hold of me in a few days.
Question 3: will her decision be final?
because i was hoping i'd get the opportunity to explain to her i have 0 money but thatd i'd be more than willing to do community service and take theft classes or whatever.
Question 4: any idea what the outcome will likely be?
anyone who has been charged particularly in washington state, i would appreciate knowing what the outcome of your case is, or anyone who knows anything about such cases.
Question 5: also, if i do not agree to the bargain the prosecutor makes and i take it to a jury trial, is my punishment likely to be more or less harsh?
thank you!!!!

You were told correct you should get an Attorney

Then call her in a few days but I suggest you get a Lawyer and let him/her deal with DA

The Judge has final say so on any plea deal

A local Attorney will best answer that as he knows Judges

YES!

i am sorry, but if i can make a deal with the prosecuting attorney and my crime was minimal (6.00) i do\ not see why i can not represent myself. what exactly can an attorney do for me in this case that I myself cannot do by learning the laws and what my options are. i am not getting an attorney. you can help me best with advice regarding what my options are and how i can protect my rights WITHOUT an attorney. i really appreciate it. also, do you think it was the diversion program she was referring to? and so if the final decision is up to the judge, if my prosecutor does not give me the chance to talk to her about the diversion program, can i ask the judge in court (i already attended the preliminary hearing)? thanks!

You do not know the laws, Judges, DA's, your options etc etc. doing this without the help of at least a Public defender could cause you not to get best deal. Is it possible you could still get good deal with DA? Sure. However would you extract your own tooth or call a Dentist?

i know this is a little ridiculous of a conversation here but i am actually the kind of person who would extract my own tooth if the proper anesthetics were available to the layperson. and i will represent and fight for my OWN rights if the proper knowledge is available. and relevant and helpful advice is appreciated. can you tell me who i make a request for a diversion program such as a stipulated order of continuance to or a deferral? does the prosecutor get to make that decision? im not trying to be rude, i appreciate your advice to get a lawyer but i would rather learn on my own.

I strongly urge you to at least seek consultation with some Attorneys. However if you must you talk to the DA about any plea deal. Over a theft so small its very likely going to work in your favor as far as plea deals goes
