I know someone who has a prison record in Texas. He stole over $15,000 in parts and sold them online. He was caught, confessed basically, and has done everything to cooperate with company he supposedly stole from a few months ago. They gave him the impression that he would be able to pay money back within a certain time frame, but he hadn't heard from them in six months. Just recently he received a call from a company investigator stating that they most likely would press charges. He is able to pay this money back. Why wouldn't the company just take the money back? If they press charges on him, they won't get anything back. He'll probably get a long sentence since he has prior record. He has a family with a baby now and is regretful of his mistake. He just wants to pay money back and everyone should then be happy. Any advice or help would be appreciated.

I'd tell your friend to get a lawyer and to expect to spend a lot of time behind bars.
 
Thank you for your input. So, basically you are saying he has no chance of just paying back restitution and them not pressing charges? Why would they have waited over six months then to press charges? Seems like they are playing with him.

A: The crime has already been committed. Restitution will not erase the crime; restitution will, however, make the criminal look better.

A: The statute of limitations on something like this could be years; six months is but a microsecond in legal time.

Why would resitution be enough after 6 months!? Senor Judge gave you and your (cough) friend your best answer. Find an Attorney
 
Plus this man has a family. The company would get their money back. Pressing charges would only hurt my brother's wife and child. What would they see from putting him in jail? Spite. If they press charges, he won't pay restitution, because his family will need that money then, because they will lose any income he would have provided. Thanks however for reading this and giving me an idea of how shallow legal minds can be.... Don't try to work things out and get the guy some help... send him to prison where he doesn't learn to stop his impulsive behaviors and hurt his family in the long run....
 
Oh and it wasnt rude to lie to us? Did you believe fact hes your brother would change replies? No it would not. Whine all you want your deception was just as rude. Furthermore I cannot even begin to count the posts that comes here from someone saying they are a "friend" its seldom true. We dont care if the alledged offender is you, your brother, friend etc. It does not change the law. You disrespected us with your deception and not want to complain I didnt believe this was a "friend". Funny thing it was true its not a friend its a family member. Legal answer is still the same. Your brother needs an Attorney

Your brother has committed a major felony.

He did it intentionally.

There's no way around that.
 
Thank you seniorjudge. I appreciate the advice. I just pray that the company will see the entire situation and accept his payment and not press charges for my family's sake...

You were not exactly up front with us.

Do not be upset with us.

Be upset with your brother.

He has done bad things to his family.

I did not come on here to give every detail of my life. It didn't matter if he was a friend, me or my brother. I am his SISTER!! I just needed some advice and not criticism or someone trying to figure out if it was me that the post was referring to or truly someone else. There are bigger fish to fry here. I expect professionalism from a site like this. I get the jist of the matter, so thank you.
