Shoplifting, Larceny, Robbery, Theft Theft in WA State...cops called, very scared...

Hello all,

I am posting here to see if anyone can offer some help/support. I was detained for shoplifting at a large big box store yesterday and am freaking out. The Loss Prevention people were screaming at me, calling me a liar etc. I basically tried to do my own exchange. Meaning I put back items that I bought (I have the receipt for one item, not for the other) and took the correct sizes without going to the Returns Dept. Undercover store security must have seen me as I am fairly certain they do not have cameras that can cover the floor at such a giant warehouse.

As I was leaving I was detained and brought to the managers office. They called the local police who came and read me my miranda rights, etc. The police were total jerks at first and then were laughing and joking with me. It seemed so surreal. I am in my mid-thirties, mother of 2 young children and terrified of going to jail for this. (my baby was with me at the time) I live in a very affluent area so I don't know if the local police have anything better to do than make an example of me. We are an upper-middle class family so not sure if I even qualify for the public defender?

The total cost for the items was less than $25.00. And I have a full receipt for one item that was $15.99. The other item was about $6.99. It was a stupid, stupid move but I have no idea what to expect. Will the DA prosecute me? Will I go to jail? What is the threshold for an infraction vs. a misdemeanor ($$ wise).

I did go to the local jail where I was fingerprinted and mugshot taken but no court date was set. The police told me that a court date would come in the mail in about 3 weeks...I dont think I can wait three weeks without knowing what might happen. I have not slept or eaten since the incident. Any help would be soooo appreciated!!!!!
 
This is a misdemeanor theft charge. You should start calling Lawyers. Many offer free consultations, get as many as you can. During these visits ask about Diversion. I would not play with the name calling of both LP and Police it can backfore on you big time. Do you know if Children's services were called? Thsi happens sometimes when a shoplifter steals and has their child with them.
 
No childrens services were called...my husband came to the store and picked up my child. Why is this a misdemeanor and not an infraction? What is the main difference? I am not name calling the PD or LP but find it odd that they were screaming at me one minute and then laughing and asking me nice questions about my child, etc. It seemed so odd. I never admitted any guilt as I was not stealing...I was exchanging. And yes, it was stupid...very very stupid, I am not proud of myself.

Is there any chance the store will drop the charges for such a small amount? Ugh, this is a total disaster...
 
We cannot say if charges would be dropped or not. Based on what you say they have a strong case. You did not go to return area what you did was routine for a theft, or return fraud. Infractions are traffic tickets, jaywalking etc. theft is either a misdemeanor or felony.
 
Well this is not a felony, it is a misdemeanor or I believe theft in the third degree (under $250) in WA. I have no prior anything, pristine record...not even a traffic ticket. I just want to make sure I can keep my record clean. This was a stupid mistake and I regret it so much. But going to jail is not something I can do. That is what scares me the most. I am hoping that I will get a fine and probation, commmunity service or whatever. I just do not want to go to jail. Is there any chance of that for something this small?
 
Just talked to an attorney, feeling a little better. I don't think there will be jail time for this. Attorney knows the DA here and will try to find out if they plan to prosecute or not. Probably will prosecute, he thinks so I need to be prepared. I am very grateful to talk to an attorney, you just HAVE to have one to help.

Thanks for the info...I will post updates as I go along to hopefully help out others who find themselves in similar situations. I am not a criminal, I made a stupid, stupid mistake. I am sure the majority of the people here are the same...good people who made one BAD decision.
