theft of services

i called a hvac company that was in the phione book explaining to them that my furnace had my a strange noise and i wanted someone to look at it. The man on the phone told me that he ccould send out a salesperson to sell me a new one, b/c i told him it was old, or if i wanted to try to keep it longer i could pay $77 and have a tech com out who would look at it and then quote me on any repairs that could be done. The tech came out spent about ten minutes looking at it and then quoted me on the price of a new furnace. he then told me that he was charging me a $158 diagnositc fee on top of the $77 service call fee. He said the service call fee was just to get him to my fron door. I asked him why when i was on the phone with the guys about 4 times today why no one said i would be getting this additioanl charge. Each time i talked to someone they said it would just be $77. When i called the gm and asked what the diagnostic fee was he was very rude the whole time and said "listen, you have a 30 year old furnace its shot..what else do you want me to tell you" He then hung up on me. Never tried to work out any kind of deal. I have stopped payment on the 200 check as i do not even have that kind of money. I then wrote them a letter explainng the situation with a check for the amount it should have been. I emailed the owner and again the GM send me a rude email saying after talking to me on the phone and after hearing from his tech how i talked to him at the time of service he is going to have his attroney contact me and if i do not pay he will file a suit for theft of services?? Is there any way i can win this?
 
All you can do is let them sue you and go to court and let the judge know what happened-- it would be up to the judge if you owe them extra $$ or not--- I would have done the same thing you did-- their ultimate goal was to get you into a new furnace

yes, b/c even when i was crying to the tech (b/c i was very upset, i thought i was only getting charged the $77 and i knew i could not pay all of it) to explain to him he was like " well we take it off the price of the new one if you buy a new one from us" he was also on the phone the whole time with his boss, and when he tried calling his boss to see if their was anything he could do as far as the charges, his boss conveintly did not answer. I figuered that all the saw was a single mom with a baby and tried to up charge me. they prob just saw a "dumb blonde" which i'm not.
