Shoplifting, Larceny, Robbery, Theft Theft on Campus

I am a student at a college in colorado and today i went into the bookstore and stole a pen and 2 sharpies. I left the bookstore and on my way out was stopped by security in where they found the pen (not the sharpies). While following the security guard to his office i threw the sharpies out of my pocket and once i was done with my conversation with him i went back to grab the sharpies and then left the building. I then got an email saying to return the sharpies or be arrested because they have me on camera, so I returned them. When i went to return them I was greeted by a cop who wrote me a ticket for theft. I was just wondering what is the worst thing that a judge will give me and what is the most reasonable thing a judge will give me as punishment. Also i have a prior minor in possession charge that I am currently doing a diversion program for (I think its called diversion). Will my MIP have an effect on what the judge decides? Any idea of what the school will say?
 
Well you have some problems now. This will likely violate your Diversion and will lose that. Fact you dumped sharpies then retrieved them and walked out could be "second" offense. You might even see jail as possible outcome with both the violation and one or two theft counts/charges. You need a Lawyer! Do not talk to store or Police without Attorney present and agree to no terms until you have. In mean time you might enroll in an Anti Shoplifting course. This will show Judge your being proactive which is always good. This "could" result in lighter sentence. This site works closely with NASP. They have such a course. The admin in the past has asked posters to send him a PM and he will give you contact info for that programs Director. I will make that same suggestions. Do you have a ticket and if so what is charge?

I do have a ticket and it says theft under $500, also i am finishing my diversion program on tuesday and my court date for the theft charge is not until december 17th. Does this change anything?
 
No it does not as the theft happened while still under Diversion terms which I assume read "violate no law" Judges do not like people who offend again (even different crimes) once given the gift of Diversion.
 
So, you got busted for theft, dumped some items then stole them again on your way out?
