Theft or Fraud? Also, I don't want to say defamation just yet.

July 7th, 2008. I had gotten a phone call from a friend of a friend who was offering to sell me an Xbox 360 with 3 games and 2 controllers. The original asking price was $600. I don't have time for video games and only wanted to play one then sell it. So I talked him down to $200 because he said he was looking for quick cash to go out of town. I agreed to the $200 because I had planned on selling it for a profit. The three kids came over and made the sale, I am still unaware of the name of the driver but do know the other two kids. Well needless to say they were leaving town and took off (Yes it was my mistake for not making them stay, but I'm a very trusting person) My mother witnessed the transaction of cash for the bag with the Xbox in it through the front window. Later Upon opening the bag I see one game case with no game, they had mentioned it was in the system, but no, it was not. I found 1 controller not 2. I plugged the system in and could not try it out without a game. I proceeded to call them back. All I had asked them for was a game to try it out with or my money back. They said they would get me a game. Three days later I called the passenger, kid in the backseat, and kid who's Xbox it was but he was not in the car. to set up a meeting to get a game to try out the Xbox with, or my $200 back for returning the Xbox. Over the phone the 3 kids, but not the driver agreed to meet up with me at four pm. When 4 came around I kept calling, they were obviously avoiding my calls. Until I got a call from one of them asking me how I was enjoying the broken Xbox. Knowing that these kids were not capable of handling this in a civil manner I contacted the parents of the owner of the Xbox and she said she would talk to her son, which was not one of the 3 kids in the car, but he was one of the kids I talked to when they bragged about the Xbox and told me that I had been "hustled" because these kids are "straight up G's". The kids mother called me back and said she was going to come over to talk. She was very nasty to me screaming in my face as I forced myself to stay calm, She had brought her son. She started screaming because her son had told her that I had given them some amount of marijuana for the Xbox which he said was only worth $100 and his friends stole the Xbox from him. I didn't even want that much from her. If what her son was saying was true about how his friends stole his Xbox then she needed to help me contact the other parents. although she told me she'd look for the receipt so I could get a brand new working Xbox, I told her that I just wanted my money. Also, I told her that the marijuana thing was here say and I have a witness. I calmed her down and she said she would talk to the other parents of the 2 other kids involved, the passenger and kid in the back seat. Two days later on the 12th, Nothing. So I proceed to the next kids parents, the kid who's phone was used to call me and he was also in the back seat when they arrived with the Xbox. His parents were very nice to me and agreed that if 4 kids were involved that's $50 from each kid, they were including the kid who's Xbox was "stolen" because her son was at that kids house at the moment and obviously wouldn't be there If the one kid knew that the passenger stole his Xbox, and I was supposed to meet up with those 3 for a game for it, so he knew the whole time. The only other parent contacted that day was the first mother I had talked to because she had brought the son of the parents who's house I was at on the 12th. When the first lady arrived with the other parents son they brought up the weed again, because this time the kid in the back seat was saying I gave them weed after coming from the kids house who first said that. So now there saying they only owe me $100. I was not gonna accept only half of my money. So this lady starts getting beligerent and saying she's gonna call the cops and report the Xbox stolen. I told her I would take the Xbox to the police station tell them who stole it, and tell them it belonged to her so she could go get it. She then said that if I were to do that. She would call the cops and file a report saying that my mother and I are drug dealers! She believes her son who wasn't there and his friends over my mom who saw them sell me the Xbox. She brought up the $100 telling me that's all I would get and she actually offered me an ounce of weed instead, unbelievable. Then she goes on to say that she doesn't do drugs, just knows how much they're worth and apparently where to get them. At this point I just wanted to leave because I knew I was not getting my money, or atleast not all of it. She pulled out of the driveway saying that we will handle this the legal way. I haven't heard anything from anyone about it since. I have returned the Xbox to them around the 13th or 14th to avoid the trouble of having "stolen" property even though the kid it was stolen from was in on it the whole time.I should also mention before going to one of the parents I called one of the kids and recorded the conversation where he admits who's Xbox it was and that he and the kids that he came here with knew it was broken when they sold it to me. I know that should hold up in court. My question is which kids parent/s do I take to court? Also, how much should I add to the $200 to cover court costs as well? Any help would be greatly appreciated. Sorry for the long post, and thanks for your time.

Wait ... with a handle like "supportNORML" you think they don't have your drug activity pretty much on the money? I'm gonna guess you really don't want the cops involved, either, so I will assume you don't intend to report this kid for the crime of fraud.

The person you sue is the person who sold you the busted and stolen X-Box. Whether you conversation can be used depends on the laws in your state. Some states require both parties to a conversation be aware of the recording before it can be used.

It might just benefit you to take this as a $200 lesson in life not to buy things from "a friend of a friend" and guys that are shady and shifty. Remember, a deal that is too good to be true, probably is. And since $200 is about half what you should pay for it and a couple games, that should have sent up some red flags.

But, yeah, it sounds like you were the victim of a crime AND have a potential small claims suit against the guy that sold you the box.

I don't think they know, because well... activists are not drug dealers. I personally know terminally ill patients with wasting syndrom and cancer. People who would be much better off if the laws were different, and it breaks my heart. People think that people that want to shut down the federal reserve are not patriotic, when in fact they seem to be the most patriotic Americans.
I've been thinking about getting the police involved because I'm innocent and the drugs are here say, I mean If she can say i'm a drug dealer and that makes it true, then I should be able to say that they are all hitler, and have them put away for genocide.
the latter is less likely but still neither one can be proven. Thanks I will check out the state law more and unfortunately the kid who handed me the bag is the only kid who's parents I cannot find. If you do not use or possess dope, great. If you do use, possess or sell dope, then you may have to wonder just what they might know.

I do know the kid who was in the back seat now, who called and set it up, and helped take the Xbox.

They wouldn't be "forced" to do anything. Your suit for $200 would be against the person (and/or parents if your state law permits it) who sold you a broken X-Box. Who they choose to contact is up to them.

The police can look beyond the kid who sold it to you to try and find the thieves, but your beef would be against the kid that sold you faulty goods.

Also don't forget about the LEAP program Law Enforcement Against Prohibition. See cops say legalize drugs, and they want you to ask them why.
So? I have met a couple of guys over the years that feel that way. I think they're wrong, and they are in the vast minority of law enforcement. There are also Republicans that support Obama ... and Christians that support abortion ... they are free to hold a minority view if they choose.

There answer is not because they are drugdealers, it's because they care about the economy, health and well being of the citizens they protect in this country.
Funny thing ... so do I, and I don't agree with the legalization of drugs precisely because of the ill effects it will have on the economy and the health and well-being of the citizenry.
