Hi everyone, i was charged with a C class ticket of theft under 50 , in a big retail store. Also i got the letter from the store saying if i pay the restitution fee, they wont proceed to a civil demand. The offense was in a city in the us/mexico border, also im not a us resident, i visit there, mostly as a tourist. What are my options?Ive heard that defferred adjudication its one of my options and when the period is over, ask for a expungtion. My citation is january 28.
 
Luis, I don't know what you chose to do. If you pay the fee then there is no need to proceed to a civil demand. That's the purpose of the demand - to get the fee. You also mentioned a citation, which I am assuming means that a police officer was present and issued it to you for a court date. There are two issues to deal with - the store and the court hearing. Yes, you can pay the fee. Regarding the court hearing, deferred adjudication is not an option that is guaranteed although it is common. It also doesn't mean anything with regard to the store's case against you. An expungement is also not guaranteed and depends upon the state and what you're trying to expunge. Others here can comment at greater length about the specifics if they wish.
