In May I stole a few deposits from the restaurant that I was the general manager at. I quit the next day and did not return. When I called the assistant manager a week later about my paycheck I was told I didn't have one. I was going to pay back the deposits with that. A detective soon started looking for me and I did not respond because I did not want to incriminate myself during questioning. I was woken up last week by a knock at the door. The police told me that I was being arrested for theft of prop in the third and I could bail out in an hour. My mother spoke to the bail bondsman who told her I should plead guilty because I have a clean record. She said it would be a slap on the wrist. No jail time, just fines. I spoke to an attorney yesterday and he thinks I can get off. There was no signing sheet for the deposits and 3 different people had access to the safe they were kept in. I really don't know what to do. It is being handled in city court. I am afraid if I plead not guilty and I am found guilty that I will face harsher penalties than if I just plead guilty and get it over with. Please help me my court date is a week and a half away. I have a family and I don't want to go to jail. Also can my attorney see the evidence before my trial. He didn't say but I don't know what my former boss has on me. I KNOW there is no video.
 
I see your issue but it would be unwise for us to advise you when you have an Attorney. Perhaps a consultation with another Attorney will help
 
I haven't retained him. It was a free consultation. I am afraid he wants my money and then I will have to turn around and pay fines if he can't get me off. That is my biggest dilemma hire a lawyer or just plead guilty.

Ak. No! Don't listen to Bail Bondsman about something like this. Huge conflict of interest. . .

Not True! You are going to arraignment where everyone pleads guilty. In fact, if you were to plead guilty without an attorney, a good Judge will pretty much stop you from doing that!

Most people plead guilty at a pre-trial conference, that's when you or your attorney and the prosecutor can sit down, and talk about the case and plea deals.

You will usually get more punishment if there is a trial and you are found guilty by the Judge/Jury.

Also, with the aid of an attorney they can work with your former employer and prosecutor and perhaps have a plea deal where you pay your employer some amount, and they are happy and everything pretty much goes bye bye. It's always possible.

Your best advice does not come from internet message boards or bailsbondsmen. It comes from an Attorney you share an Attorney/Client relationship with. If you doubt your Attorney advice or intentions consult another Attorney
