I had a debt with a certain Credit card company, they ended up charging the debt off in Dec of 2006 the in Jan 2007 a third party collection service bought it from my orginal creditor. I then recevied a letter from the third party stating that I owed them "x" amount of money, I told them I have no idea hwo they were and asked why I owed them money, and they stated they had bought my debt from a creditor of mine. I asked if they could send me a legal contract in which I signed into an agreement with them to tak over my debt, but they could produce such a document. I then ask if they any kind if documention stating why I owed them this money, and again they could not send any thing of that sort. It is now Feb 2008 and that third party now has a lawsuit againist, stsing that I owe them money. I live in GA, and I am not sure of the laws that govern this type of situation. DOes this third paty have a legitment lawsuit againist me, or what option do I have. Also to note they had contacted me a couple times through the phone harrasing me, my mother and my sister who live in another state, who they got her number I have no clue.
 
You are chasing your tail on this....by charging off your debt, the credit card company took a "loss" AND they can then ASSIGN your debt to another/third party for pennies on the $$$ you owe...formulate a letter to send to these agencies that you do not owe the money and you know it has been written off...where you really want to keep an eye on is the 2nd co also dinging your credit report...keep an eye on this and report it to the credit bureau when it happens.

You are chasing your tail on this....by charging off your debt, the credit card company took a "loss" AND they can then ASSIGN your debt to another/third party for pennies on the $$$ you owe...formulate a letter to send to these agencies that you do not owe the money and you know it has been written off...where you really want to keep an eye on is the 2nd co also dinging your credit report...keep an eye on this and report it to the credit bureau when it happens.

I will write the letter and see what comes of that. The collection company has already reported this on my credit report, and I have a complaint with the FTC about this, so they are going to look into this. I was also told to write a certified letter to this company and to advise them to stop reporting inacurate information about me, so that they will remove this blimish form the report also....Is this correct????
 
If they have actually filed a lawsuit, it is too late for any of the above. You need to answer the suit and show for court. They will have to provide documentation of the debt and then the judge will give them a judgment against you unless there is a defense.

just wanted to say that it really doesn't matter that the debt has been "charged-off", you owe it in any respect and the assignee has the legal ability to report to credit reporting agencies that they are collecting on the said debt.
