my boyfriend has been dealing with the same situation for nearly four years. he stole a car and was arrested for it, did about a month or so in jail, got bail, and was released. He went through court for about three and a half years, of his lawyer just putting it off everytime. we believe that is because he was just money hungry, as he has gone from legal aid, to high profile criminals and no longer deals with legal aid. My boyfriend recently turned himself in, about two months ago because he wanted this all dealt with sooner than later. Don't get me wrong, he committed a crime, but he didnt attempt murder. Why is the courts allowing this to be put off for such a longer period of time? I need some advice. I dont know much about the law, but i'm hoping someone can give me some postive advice that I could share with him while hes in there. He would do anything to come home, but would rather this all be over with. He was 18 at the time it happened, and regrets it immensley. PLEASE HELP.:(
 
It sounds as if he has agreed to "waive time" at his court appearances. He may not realize it, but through his attorney he has likely waived his right to a speedy trial, and that is why he keeps going back. If he isn't doing so, he should get in the habit of asking the attorney questions and making sure he understands what decisions are being made on his behalf.

Why did he have to turn himself in? He had a warrant? Did he miss a court date?

Things don't really add up here.
 
You aren't helping, even though you mean well. He is only accused of committing a crime. Unless and until he's convicted of that allegation, he remains as innocent as you or I. That is the message you should communicate to him. He should shut up, and force the state to prove their allegations. I doubt that after all these years that would be easy or that the state would have much interest in doing so.

He should, as Moose said, speak with his attorney. the best thing he can do now is remain silent and wait. Only idiots are accomplices in their own lynchings!
