Threatened with Eviction a Week Before the Lease Ends

This is in the state of Pennsylvania.

The one year lease of an apartment that I'm renting will be ending on August 31st, 2008. When I moved in, I paid the first month of rent and security deposit, which were both the same amount.

At the end of July 2008, I called the management company and asked if I could use my security deposit for the last month of rent. The person I talked to told me that that would be no problem and made sure that I understood that any unpaid rent for the month of August will be taken out of the security deposit.

I received a call early this morning from the management company telling me that if I do not pay in full by 9am tomorrow morning I will be evicted. I told them that I had talked to someone there in July who told me that I could use the security deposit for the last month's rent.

I went to the management company in person and talked to them more about it. Again, I told them about the information the person (I did not recall their name) told me in July -- as soon as I said this, the person I was talking to rolled their eyes, named dropped someone, and told me that the person I talked to (who they could obviously figure out by what was said to me) didn't know what they were talking about. They told me that if I don't pay them the rent for August by tomorrow at 9am I will have to pay a large sum of money in court costs.

Is it my fault that an employee obviously known for their incompetence told me the wrong information? If the person I talked to told me the correct information I would have had no problem paying the rent. I have only paid rent late once along with the late fee required (it was a day late -- I was out of the country and this was in March). I don't know if I should pay them or if I should just move out tonight being that I have other places to go and my lease is over in a week anyway.

I'm in desperate need of an outside opinion before I make any ridiculous decisions. Any help at all is greatly appreciated.
 
You will not be evicted tomorrow. An eviction takes time as it must go through the court system.

You will, however, likely find yourself being served to show up in Small Claims court in the future when your landlord files against you for failing to pay rent for August.

You can avoid this by paying the rent (plus any late fees) by 9 am tomorrow.
