My partner and I used a friend to concieve a baby.. the friend and I did it the old fashion way bc we figured it would work better, anyways now that our son was born he has changed his mind and is fighting for custody, we have a lawyer and understand he is going to have his rights, but another friend mentioned maybe he would agree to a THREE WAY custody.. I was just wondering what that was and what that would mean for my partner, what rights would she have?

Oddly enough, in Kentucky it IS possible for custody to be shared between the two legal parents and a third party (usually a de facto parent).

But this is not something you want to try by yourselves; you really need an attorney.

If Dad doesn't agree to your partner being the de facto parent, you'll have an uphill battle on your hands.

yeah we have a lawyer and our mediation date is in two weeks we are hoping he will agree to open adoption but will ask for this if he doesnt, mostly just praying right now, but needed more info on what a three way custody is

You should really rethink the idea of giving your sig other custody rights to your child. As the laws progress, non biological custodial parents are sometimes awarded sole or residential custody, then move several states away with the bio parents child.
