Ticket for 21460(A)

I was in an accident about a month ago in which my vehicle was totaled. On rain slick roads my car slid and spun exiting a turn. I was not cited at the scene and no mention was made of any violations at all at the time. I now receive a courtesy notice charging me with 21460(A) VC-INF.

If ones car crosses a double yellow line during an out of control spin and accident, a citation can be issued?

It is not like there was any choice.

Is this legal?

Any advice would be greatly appreciated.

After an investigation, the police can issue a citation that involved a motor vehicle and an accident.

The ability to issue the citation, is legal.

Whether the charge is legal, only a court can decide.

You have ONLY been charged.

You are innocent until proven guilty.

You can plead NOT GUILTY and fight the citation.

You can hire a lawyer to fight for you.

This is not over until the judge gavels the proceeding to an end for you and says "GUILTY" or "NOT GUILTY".

If it isn't worth all the effort, or you think it'll take forever; call the court clerk and ask if you can take an online traffic school to make the ticket go away.

The clerk can tell you all about it and IF your ticket qualifies.

If the clerks says no, you can still appear in court and ask the judge for permission to take the class.
 
As the driver of a vehicle you are responsible for the control of that vehicle. If you lose control you are still responsible for any violations that occur.
If your brakes were to fail and you run a stop sign, you are still in violation of the stop sign.
Under the circumstances the court may dismiss the charge... issuing the citation is a way of showing who was at fault for the accident.
Yes the citation is legitimate, and yes, if you fight it in court you may get it reduced or dismissed.
