My husband recently received a ticket for having a suspended license in Nevada. My husband drives a truck for a living and currently carries a CDL from the state of Colorado. He was pulled over for a random DOT inspection. It was during this inspection that he was informed his license was suspended. He knew that this was incorrect and told the officer so. While the officer was doing the inspection my husband contacted the courts here in our home town to find out what was going on. He was told that his license was current and valid and had papers faxed to him confirming this. He told the officer this information and he still issued the ticket. Now they was him to pay a $287 fine for having a suspended license. Is he required to pay this fine? It seems like he is being punished for a clerical error from the state of Colorado. This fine is taking the money we were going to use for Christmas for our children. How can this be legal??

He needs to enter a not guilty plea with the court. He does not need to pay the ticket because that will be on his record and you will never get it straightened out. Get a certified copy of his record from the Colorado DMV and submit a motion to dismiss to the court. All contacts with the court need to be in writing CRR or, if you do talk to someone, be sure to get their name and confirm the conversation. You need to do this immediately and before the court date on the ticket. It is possible you may need to have an attorney get with the ADA but you may be able to handle it yourself. If you pay the ticket, his Colorado CDL license will be suspended. If you need more help, send me a private email.
