A truck was towed to our garage on 12/26/07 and left after hours with a note from the tow company that owner would call.

Two weeks later, the owner calls to say the motor needs to be replaced and he will have one delivered on 1/18/08.

The motor never arrives. Two weeks after the expected arrival, we attempt to contact the owner by phone but get a recording that the number is disconnected. The owner lives in Pennsylvania (my garage is in NH) and is "a friend of a friend" so we ask our friend if they know how to contact him because we are tired of having his vehicle take up space in our small lot.

On 2/19/08 the owner contacts us to say his phone has been re-connected and he will be deliving the motor personally on 2/23/08. He did not arrive.

I have now been storing this vehicle for two months without performing any work on it.

My questions are:
What can I legally do and how much longer should I wait to do it?
Can I charge storage for this vehicle and if so, starting from what date?
Alternatively, can I have it towed from my property with the owner of the vehicle being responsible for the tow and storage fees then?

I appreciate any comments/advice that you can provide as I am a fairly new business and cannot afford unnecessary legal expenses.

Sounds like abandoned property to me.

Condemn it under your state's abandoned property law.

It seems to me that the owner may know the laws governing abandoned property and that is why he calls at 30 days +/-.

Can it be construed as abandoned since he calls once a month? My understanding is that abandoned property is when you do not hear from the owner.
