my daughter was hit in a private parking lot there waqs about 5,000 dollars damage
the cop said no one can be sited because it was on private property shouldn't her
insurance be liable for this

The girl that hit my daughter said her insurance company would not pay it because
no one was sited because it was on private property Clearly the other girl is at fault and she know it I talked to my insurance company and they said if they deny fault there is
nothing they can do about it. I will have to claim it on my insurance. My insurance will
go sky high
 
You can file suit in small claims court for the damage. This means that you would have to go ahead and pay the money out of pocket to fix your car or get your insurance company to assign their right of collection to you. Unfortunately there is little to be done since the other driver will not admit fault.

If you do take them to court they have the option of countersuing for their damage.
 
REalize that no citation does not mean no fault

It may vary by the state you live, but a lot of times it is easier to have your insurance cover the damages and then if they determine the other person is at fault they will subrogate the claim and try and get the money fro the other insurance company. If they win then they should get you any deductable that you have paid as well.

Your insurance company has more experience with this process than you so that is why I recommend letting them go through the process.
