Traffic Ticket in New Jersey

A police officer gave my son a traffic ticket for driving my car with one of the headlights out. This happened in Northern New Jersey where we live. I know when I lived in New York City if you got a ticket there for the same thing, if you had it repaired within 24 hours and showed proof of the repair at the police station they forgave the ticket and the fine. Do they do the same thing in New Jersey? By the way, the police officer made the ticket out to me even though I was not in the car and my son was driving. Does that have any significance?

Absolutely that has a significance! First things first. Most jurisdictions will dismiss an equipment ticket if you repair the problem. Do that first. Secondly, since YOU were listed on the ticket YOU show up to the hearing. Unless your son was summonsed do not have him there.

If they refuse to drop the ticket because you repaired the problem plead not guilty. When the police officer testifies point out that you were not driving that night. The ticket will be dismissed.

I take it the license and such on the ticket is that of your son not you? I don't suppose you have similar names: like he is a Jr? That would make it an honest mistake and then he should appear.

The ticket had my driver's license number and name, not my son's. The officer must have gotten it from the DMV computer as I was not there.

I don't think it is so significant... certain violations are citeable to the owner of the vehicle rather than the driver. The citation should have a section for driver information ad another section for owner information... if it doesn't, the officer's copy likely indicates your son as the driver in his written statement.
Anyway- it isn't that big of a deal... it is a fix-it ticket. There should be instructions on the back that explain what to do to get it signed off. Though they will dismiss it and there won't be a "fine", many jurisdictions will still charge you an "administration fee", which is basically a $20 or so fee for the signature.

You should probably listen to Moose over me. I don't know NJ law. Further I can't get over laws that hold the OWNER responsible instead of the driver but I know they do exist.
