I was recently issued a citation for "Disregard Traffic Control Device" (NJ 39:4-81) for making an illegal left-hand turn from a parking lot. When making the turn i did not notice the sign indicating that left-hand turns were not allowed. The New Jersey offense listed for that statute number is "Failure to observe traffic signals." This may be semantics, but "failure to observe" and "disregard" (as written on the ticket) have two entirely different meanings. The word disregard implies willful intent.
My questions are - do have much a case because:
1. I did not notice the sign before making the left hand turn?
2. the statute written on the ticket does not match the actual code and it does not technically describe the alleged offense?
any assistance would be greatly appreciated.
