Greetings, my first time posting here, I didn't think any place like this was on the net. I'm Marc & I want to thank you for taking time to read this & give me your input.
My coworker/friend recently perished in an auto acident. He was pretty young & did not have a will. When he moved from California 5 years ago to start work here, he put his girl friend at the time as his beneficiary for his company sponsored life & AD&D insurance. Since that time, they broke up & he was engaged to be married to someone else. There was no will that anyone could find.
*His mom & dad are divorced & both live in California
*His brother had just moved to Texas 12 days before the accident to live with him & get a fresh start working with us & to live with his brother (age 20) before he moved to Canada in a year or two.
*He was engaged with a young lady that lives in Victoria Canada (she paid for the funeral)
*The mother has the death cert. & I think did all the paper work at the funeral home.
*His next of kin in Texas at the time was his brother
His former girlfriend said she would willingly sign over the benefits to the family. The problem is now that the family is starting to fight over what is going on. His parents are divorced & he left his father to live with his mom before coming to Texas because he couldn't stand his father. Now the father said he is talking to a lawyer to get everything signed over to him. His mother has the death cert. and is the one that came down along with his fiance to arange the service.
-Do the parents have any ground to take her to court ?
-Can the former girlfriend (beneficiary) sign over the benefits to the brother or anyone she sees fit? Idealy she wants to sign it over to the brother because she feels he would be fair & honor his brother by dividing it up equally AFTER taking care of all his bills/debts.
-Can the former girlfriend get a copy of the death cert.? I think she needs it for the insurance, if so, how can she get one if she's not a family member.
Also, the father had made statements that he didn't plan on paying off any of his son's debts with any of the money he may get & his brother is upset because he doesn't want anything left undone to tarnish his brother's name.
Sorry if this is a bit longwinded, I'm too involved in this already but his younger brother is only 20 & his parents don't seem very responsible at all. His monther came down from Cali but left hours after they had a small service & didn't stay in town to tie up any lose ends & now expects her 20 year old son that's here without a car or job yet to do everything.....the essentially came down, raided his aprartment, took the 'good stuff' & left me & his brother to clean out his apartment.
