I was hired by Company A in 2001. At that point I signed a non-compete agreement if I left the company. In January of this year, Company A went bankrupt, closed down and sold all our contracts to Company B which was made up of most of the same people as Company A. From January through March, Company B paid only small amounts (less than a full paycheck - total) and those did not have taxes withdrawn, telling us we are now being paid as 1099.
Bottom line is where does this leave my non-compete? Three of us would like to start a similar business in Wisconsin, but do not want to face problems from Company B.
