Approximately 3 weeks ago my husband (a production manager with a government contractor) who was a salaried employee for the past 3 years with this company, was moved to hourly status along with all other members of management. They were notifed via e-mail on the 8 day of the current payroll period and told that the status change would be retroactive to the beginning of the current payroll period with NO overtime being paid and time not worked in leui of 40 hours would be docked.

Today, my husband was notified that he has to go to Germany for training on May 25 thru May 31. Not only will he be required to travel for the company on a Sunday and Saturday - which are non work days, but he'll also be in Germany and working on the companies behalf on Memorial Day - a paid company holiday.

Inevitably the company, as I know how they operate I used to work there as well, will want to only pay him for 40 hours that week - as they would have if he were a salaried employee. Being that he is no longer salary won't they have to legally pay him for the Saturday and Sunday as overtime as well as double time for the holiday now that he is an hourly employee?

This company always send him on trips over holiday weekends which takes him away from not only his family but he's not compensated any extra or given any comp time either. So now that he's hourly if they want the service aren't they required to pay overtime and double time for the appropriate days? The companies personnel policies state as such for hourly employees so if they don't pay up can I file a compliant with the department of labor against them?

What state are you in? Double time is only required by law in one state, and only in that state in very limited circumstances. There is no law in any state requiring double time for the work on holidays, and only two, possibly three (the law in one state is contradictory) where time and a half is required for work on holidays (and only for some employees at that).

Also, you will need to tell us what his regular hours are and what hours he will be traveling. The laws on pay for travel time are rather complex.
 
His hours are Monday - Friday 8:00am to 4:30 pm. In Virginia. I realize there is no law regarding double time but the companies personnel policies clearly state that hourly employees required to work on holiday will be paid double time. He will be leaving on flying out on Saturday 24 and flying back in on Sunday June 1. Don't know the actual time of flight, but international flights always require a 3 hour arrival before flight time plus there will be the hour drive to the airport as well. I do know the flight to the part of Germany he is going to is a minimum of 10 hours each way.

In addition, my husband questioned his employer today regarding payment for hourse worked over 40 (including travel time) and he was told by his employer that they would pay him 8 hours straight time for both Saturdays and Sundays he was in Germany and travel. The key word here is STRAIGHT TIME, when within the 9 days he is gone he will have 72 hours in + 8 hours holiday pay. He should be paid 32 hours OT, however they are trying to tell him they are only going to pay the 32 hours as straight time. Isn't this against the law for an hourly employee. How does one go about filing a claim for unpaid wages. Also this employer is a government contractor which means he is held to an even higher standard via his contract. So anyone know how you would go about alerting the government contracting office of his illegal practices when it comes to wages and compensation?
