Hello, I am a Trustee of a Trust that has six beneficiaries. One of the beneficiaries is half owner, and the Trust became half owner of a house in a Probate Court judgment. The beneficiary who owns one-half of the house has now filed Chapter 7 Bankruptcy and is surrendering the house. The mortgage owed on this house by the beneficiary is more than the value of the house so there is no value. With little money left in the Trust to distribute to the beneficiaries would it be wise to go ahead and distribute the funds now? Does the mortgage company have any recourse it can use against the Trust to get thet remaining Trust funds since the decedent co-signed the mortgage originally?
