My stepfather passed away five days ago. He had a lot of debt when he passed. He was living in a trailer with my 24 year old sister. She would like to take over the trailer and remain living there. She is having some financial issues of her own and CANNOT take over and pay on his debt. She is interested in continuing the payments on the trailer. The mortgage company told her that she needs to file papers to become power of attorney. Once she does that she can take over the payments without having to go through credit checks. We are concerned that she will have to be held responsible for his debt if she becomes power of attorney. There was nothing left of value except a vehicle that might be sold for under $1000.00. His other children were looking to sell the vehicle to help pay for the funeral. Can you please let me know if she will be accountable for his debt if she moves forward with power of attorney? Can the car still be sold and used to help pay off the funeral?
