Tuition Reimbursement

I was reimbursed for tuition through my employer under the stipulation that I must stay an employee for one year following the reimbursement date or repay the funds within 90 days of terminating from the company.

I am now in the position to have to repay the company, however, I cannot afford to do it in the specified amount of time. If I send them a letter along with the first payment outlining a repayment schedule of 6 months, can they pursue legal action against me?
 
They CAN. That does not mean they WILL.

But rather than simply saying, this is what I am going to pay and when, I would suggest discussing it with them ahead of time. They are more likely to be cooperative if they are given input.
