My best friend was supposed to be married next month but he found out his girlfriend was cheating on him less than 30 days before the wedding. So he did the smart thing and called it all off. Well, three days before he found this out, we went in and finally got fitted for our tuxes. My problem is that i paid for my tux and a friend who lives out of state (he gave me his measurements to turn in) on my credit card. The total was about $256.
So after I found out that the wedding was off, I called the rental shop and told them to cancel my order and refund the payment on my card. The lady who answered the phone went to defense mode instantly, and told me that they have a no cancellation policy and that there would be no refund. I told her politely (well... as politely as i could) that I was not informed of this policy, that i signed no agreement or contract involving any form of cancellation/refund, and that the only form I had signed that day was the credit card receipt. She then proceeded to tell me that she had a signed contract with the bride for the 14 tuxes/dresses and once again told me that i wouldn't be able to receive a refund for any of it. So I tried again to tell her that I understood that she might have a legal contract with the bride for the 14 rentals, but that I had neither signed or had any verbal contract with them (I am also the only one out of the 14 to have paid for my tux rental (and my buddies too)).
So... who's right here? I never signed or had any contract with the rental shop. In the 15 minutes i was in the shop i only had my measurements taken, signed a credit card receipt, shook hands with the lady, and walked out. I am planning on putting a stop-payment on the credit card fee in the next 24 hrs if I can't get this resolved with them. I would also like to state that I am an 27 yr old vet who basically lives on the G.I. Bill while I attend school and $256 is a lot of money to me. Thank you for any advice you can give me.
