Alcohol & Drugs: MIP, MIC, Intoxication Underage Consumption in Ohio

I was at steak and shake with some people last night and all of the sudden the cops come in yelling; "ALRIGHT WHO OWNS A WHITE LEXUS", and it was my friends car that i didnt even drive with, and they saw beer in his cup holder. So after this i walk outside after they have the kid who owned the car in handcuffs and they automatically accuse me of drinking and give me a Breathalyzer test, and i blow a .06. I am 17 years old and i already have 1 underage consumption last august and i chose the diversion route and took classes. Did they have a right to breathalyze me, and what will happen the second time around with the judge?

They can certainly ask. The question is whether they could compel you to take one if you refused. That question will depend on state law and whether the officers had any reason to believe you had been drinking.

You are free to ask mom and dad to hire an attorney for you.

Otherwise, it's time to take a different road and stop drinking ... you're too young, and you already have two arrests/detentions for this. This should be a clue that you have a problem.
