Alcohol & Drugs: MIP, MIC, Intoxication underage consumption with a twist

i got a ticket for underage consumption. the police officer said that if we gave him fake ids(if we had them) then we wouldnt go to jail so we did. he can not bring that up in court since he didnt charge us for them can he? also, would having a lawyer get me out of this since i was never given a breathalyzer and the cop told me that i wouldnt have to go to court(meaning he lied to me)? help please!! i dont need this to go on my record or else ill never get into college!

The officer may have lied to you but don't let this worry you. Hopefully if this is your first offense you might be able to have some agreement where "adjudication" of the case is "withheld" meaning that you have a probationary period to complete and the case will be dismissed against you. There is no requirement to give you a breathalyzer test and there are many ways to be guilty of underage consumption -- seeing you drink is one good example. A breathalyzer is used to measure quantities of alcohol and my understanding is that a minor cannot drink any quantity of alcohol or possess it.
