Alcohol & Drugs: MIP, MIC, Intoxication Underage Possession Charge

I am 18 years old and from Virginia. Recently I was charged with underage possession after a party I was at got busted. I was asleep when the police came in and they woke me up and made me take a breathalizer. I blew a .17. Although I had been drinking there was no alcohol in my possession, vicinity, or vehicle when the police woke me up. Was I charged wrong? If so, what should I do, get a lawyer or go to court on my own? If the charge is upheld what penalty do I face?

Your blowing a .17, which is very hight, is proof enough and there needn't be found any alcohol in your possesion. It won't hurt to at least call and talk with some lawyers. Most won't charge anything for an initial consultation.
