my previous employer stop my unemployments benefits. i never quit and i did not know i was fire. this happen during the time i was on vacation. i had my vacation approved by my suppervisor months in advance. prior to my vacation there was a metting with the controller, general manager and accounting manager and the accounting staff to informed the GM of how the job was going to be cover while the controller was on vacation two weeks for christmas and new year also to discuss my vacation which was suppousted to start on january 7 to the 20 my supervisor Accounting Manager informed them that she will do my job and before i leave i was going to leave everything done for the month end close, reason for what i work extra hours for about two weeks prior my vacation , also weekends and holidays at the metting we all agree of that, now on tha 6 my suppervisor submited my vacation form to HR and HR told her that it was suppousted to be submited two weeks in advanced and they did not want to approved my vacation, the form was not submited before because in order for me to have all days to cover my vacation i had to work christmax and new year reason why the form was not submited before, and my supervisor told them that there was no problem because she was aware of my vacation while ago and she agree, approve my vacacion as the person on charge of me, but they want it to apply their book of rules to me saying that has to be two weeks in advance and that the rule is apply to everyone, every employee with no exception but that is not true because the controller went on vacation on a black period that is how they call it, chritsmas and new year absolutly no one can take vacation because is a high season for the company and when i talk HR of this, they said well her boss approved it, so then it is the same situation for me my boss is here and she says it is ok, conpany will no be affected also she will do my job because she was aware of it plenty time in advance,then i believe this is discrimination because they want it to apply the rules only to me, i felt so frustated of this, i tried to talk to them, explaining them that the GM,troller and my boss new of my vacation. I did not Wake up on Janury 6 and decided to go on vacation. it was planned time ago and approved by my boss all the time, I did not work more than 12 hours a day weekends and holidays for nothing. Now i will have hearing this week and my boss will testify, do i have a change to win and also is verbal agreement accepted by ny state as a proof. I do not want the job back all i would like is my unemployment benefits to be recognized. also the employer says i abandoned my job, how can i abandoned, if they let me go sending me a letter that i no longer enployed by the company and i always had the permission from my boss.
