I had to leave my job because of mental health issues. My employer was aware of my condition. I was extremely depressed and suicidal at times.
I ask for assistance with my job duties during of periods of heavy work load. My supervisor reused any assistance during peek periods and I had no option other than to resign.
I took a new position 2 months later thinking it would be less stress. I was still dealing with the effects of previous employment and was discharged after 4 weeks because of poor job performance. NEVER been fired before!
I filed for unemployment and was denied because previous employer said I was under no more stress than any another employee. It was a South Carolina State Agency I worked for.
I need to know if I have grounds to file a complaint under the American with Disabilities Act. And should I retain a lawyer to defend me for unemployment compensation?
:)

file with eeoc asap, there are generally time limitations involved. a lot of employment law attorney's will take cases on a contingency basis, and while eeoc is investigating, you may want to pursue obtaining your own attorney in the matter. an attorney will also handle unemployment for you as well.
