Uninsured Dominoe's Driver

I was hit by a dominoes driver who failed to yeild entering ongoing traffic. She was on her way to deliver pizza. She was uninsured. Is Dominoes Liable in any way. Are they responsible, in any way, for an insured or unisured driver while their on the clock driving. I really don't what specific questions to ask but, I can't afford to end up pennyless because I dont know the fine print. The driver she hit was a pregnat mother who needs her car for the upcoming baby. Any advice or pertinent responses would be greatly appreciated. Thankyou
 
Find an attorney and don't talk to Dominoes or anyone else about it. Dominoes tries to avoid liability by having independent contractors but they have certain responsibilities such as insuring the people they use have insurance. They will pay off. Get an attorney.

If you have uninsured motorist coverage on your automobile insurance policy, you have no worries.

You should turn your claim over to your insurance company.

They will repair your car, and subrogate against Dominoe's for their indemnification.

They will also work with you to indemnify you for your medical care as a result of this accident.

Dominoe's is responsible for the acts and omissions of their employee's under tort law.

This is called the master-servant theory.

You should speak with an attorney in your area to represent you in this matter.

Once you have selected an attorney, you will have no out of pocket costs.

The attorney will take your case on a contingency basis.

In other words, if you don't get paid, neither does your attorney.

Your attorney gets a specific percentage of any award you receive from a lawsuit or settlement.

This amount is usually between 25-33% of the total award or settlement.

You should engage your attorney tomorrow, and certainly no later than Monday.

Ask your friends and relatives for recommendations of attorneys in your area.

Of course they are liable! No question, ands, ifs, or buts about it.

The doctrine of Vicarious Liability makes Domino's Pizza 100% liable and they are on the hook for this one. Also known as "Respondeat Superior," it holds employers liable for negligent acts or omissions of their employees while in the course of employment.
