My husband went to get his DL renewed yesterday. In the state of NC they have changed the law and they check you by your SS#. The DMV pulled up 2 North Carolina driver's lic. #s. My husbands current and another that had a seat belt ticket, driving on a revoked lic, and failures to appear, which issued a warrant from 1994! His father has the same name and my husband had a NJ drivers lic. at the time, not a NC lic. He doesn't recall getting pulled over.He went to the clerk of courts and they couldn't find the ticket and the police officer had retired by now. He was told to go the the majestrates office, but he would be arrested right? He is a laid off carpenter. What are our options, would it be cheaper to get a lawyer to supeona his records, or go the majestrate and get arrested and set a court date? My husband has had problems with identity fraud by his father in the past, but has never been proven.

If he goes to the Magistrate's office on a 1994 warrant they are not going to arrest him. Don't bother with a lawyer yet. Go to the Magistrate's and tell them you think this is a mistake and you need to be shown proof of the tickets. They are going to work with you. When you find out what is up, come back with the information and we will help you out.
