I was smoking a joint in the woods behind my college campus when a cop rolled up on me. I was charged with unlawful possession of marijuana(221.05)and was issued a ticket to appear at court and was told by the cop that i would have a fine to pay. A little over a year ago I got ACOD for a year for possession of marijuana (I had about .1 of a gram in a grinder). Now this is about two months after the ACOD is over and i'm 18 years old now, would this be a first offense or a second offense in the New York state law?
Since I'm in school one of my main concerns is losing federal aid. Could I lose the federal aid I currently have if this is a first offense change(what about a second offense charge)?
Would it be wise to plea no contest and what kind of punishment could I expect to get? Could I get put back on ACOD or is it a fine?
Another concern of mine is if I do plea no contest and get a fine would this be on my record if it is a first offense or second offense?
