Hello:

My boyfriend has a 14-year-old daughter with his high school girlfriend. Paternity and an order of child support was established when he was 17-years-old in the state of New York. At the time, both mother and father of the child resided in the State of New York. He made his payments through the courts and soon after she vacated the order.

Mother and child soon moved to Florida when the child was approxiamately 2-years-old. Contact was lost. When the child was about 8-years-old the mother then asked for another order of suppport. He complied and thereafter the mother "allowed" him to see his daughter. She vacated the order again and they came to an out of court agreement as far as child support payments and he has been paying every month up to present date. Recently, she asked for another order of support (she no longer wanted to have contact with him). The payments come out of his paycheck and he also sends extra money for whatever his daughter needs. The mother is now limiting contact with his daughter. She no longer allows her to come up to New York to see her father and puts restrictions on when and where he can see her when he visits Florida.

He does not know what his rights are. He would like to seek legal visitation rights for his daughter and does not want to have restrictions made by the mother.

He does not know whether to petition Florida or New York courts since paternity was established in New York State.
