Hi,
my husband and i need to change our current 12 month lease agreement to month to month since we are planning to move because of his new job. the leasing office, manager did not send us a written notice regarding renewal giving us the option to change lease agreement but automatically renewed it to 12 month without giving us any notice. we notified the office about change before the lease ends, but now management is giving us a hard time. do we have a case? is there a law we can use to get the property management to change our lease due to negligence?

Thanx for respose.
The original lease states that the landlord must give notice to tenant before lease expires about renewal. The notice from last year (2007) states that if tenant do not give notice within 30 days to move then lease will convert to what previous lease was, which in my case is 12 months. month to month with rate increase.
It did not specifically state the time limit a tenant have to inform leasing office to change renewal terms. It just stated to inform office before lease expires about what wants in terms of renewal. Before my lease expired which is end of May, I gave notice to office that I want to change terms of renewal to month to month instead of 12 months, But management claims it's too late. I am now locked into 12 month lease. What can I do? Can I legally fight landlord to change terms of lease because I did not even get the notice landlord claimed to have sent. What are my options?
