Copyright use of 3rd party images

Hello guys, I'm new here but wanted to try the forum out.

So I had a question regarding the use of 3rd party images such as characters from a video game to use on your website to help generate the style of your website. Is there any way to do that in a non copy writing way? At what point does it become copy write and what are some solutions / best practices?

If there's any doubt, just don't do it.
If you do use such characters, you'll probably be contacted by the owner's attorney demanding you "cease and desist",as well as "take down" the cute, little guys and gals.
Proceed cautiously.
