Vacation rental, cape cod MA

A vacation home is being rented out [independently] by a real estate agent on weekly terms in Cape Cod, MA. During a phone conversation, my friend and the real estate agent agreed to a one time weekend rental at a rate of $1100. The rental agent declared that full payment was due immediately. My friend mailed the check which was cashed by the agent, but the agent delayed in sending the lease. A week after the initial phone call/verbal agreement, my friend canceled the rental reservation for personal reasons and asked for a refund of $1000, less $100 for the real estate agents "trouble".
The cancellation occurred 1 week after the initial agreement and 2 months before the weekend of the reservation. The real estate agent is now refusing to refund the money and has offered only 50% (after an argument on the phone). He has delayed even this response for about a month. Does my friend have a right to be refunded the entire $1100? A lease, nor anything else was never signed and the property will not be rented. 60 days notice was given even though they had never discussed any type of cancellation policy.
 
I can only assume that since no cancellation policy was mentioned and payment was made in full, then there would be no legal recourse. If I am wrong, perhaps someone else may chime in.

Though, having been a Resort Manger years ago, it was our policy to refund in similar circumstances only for that portion of the rental that was re-rented or in special circumstances such as death in family. Has your friend inquired if the vacation home was re-rented for this period?

Keep in mind that your friend's reservation may have bumped other potential clients because the "home" was reserved. Getting last minute guests to fill in for a cancellation is not always easy. This is potentially lost income for the vacation home's owner and not just "trouble" for the real estate agent.
 
Thanks for your reply. This case actually was for a death in the family, which was explained. The real estate agent also owns the house, which is why $100 was offered for the 1 week that the reservation was held. The agent/owner said that nobody else is renting the house for the whole summer (and this reservation was for a non-peak weekend that he normally would not be renting anyway). I don't believe re-rental will occur since it is off-peak.
 
Would the agent/owner be willing to transfer the reservation to a future date? Is that an option for you?

I personally feel it is rather lousy of the owner not to give you due consideration because of the situation. Even if proof with a death certificate was requested, he should have refunded your money. Like you indicated, it was non-peak season.

As to your original question, I can only provide my opinion and that is I do not believe you would have any legal recourse.
