Scenario:
A person goes to a local 7-11 store and fills car up with fuel. The person then realized that the fuel bill cannot be paid. The attendant contacted management and management requested police. Police arrive and the attendant explained that the person cannot pay for fuel but just wants police to obtain the person's pedigree information so they can allow this person to return the next day to pay for fuel.
Questions of law that I have in this scenario.
Did 7-11 engage in a verbal contact with the person that pumped the fuel, and if so, does this null and void any potential criminal prosecution in the event the person fails to return to pay for the debt?
If this does not null and void criminal prosecution, can this person be charged with stealing by deceit after the verbal contract was made?
