My husband is the custodial parent of his daughter. He is deployed and she has been left in my care. His ex wife has mental issues and has physically threatened me in the past and I'm pregnant and fear a physical altercation with her. Meeting in a public place doesn't help either. She's hit my husband in the designated meeting place in the past. She lives 12 hours away. Since he's deployed via military orders do I still have to honor her visitation agreement.

Absolutely. Follow the order to the letter as your husband, the custodial parent, can get into a lot of trouble for witholding visits. This can be used against him to reverse custody, but thats probably far-fetched.

What does the order say? I would arrange to do the exchange at a police station so that you can at least have backup if needed.

Send her a certified letter with return receipt requested stating where you will make the child available for thr exchange. Again, pick a police station for security reasons. They have cameras so she will be getting into trouble if she tries to pull something silly.

Not so fast.

Is there actually an order transferring Dad's time to his wife?

THAT would be incredibly unusual but we need to know that before we can even begin to answer.

And if you read the post again, Dad's not withholding visitation and neither is Stepmom. The child is in Mom's custody for the duration of the deployment.

I agree, Pro, and it's highly unusual.

In fact, it's oft times a reason people can't deploy.

It also seems to be violative of the bio mom's rights, had she wished to assert them.

I agree, we need more information before we can offer a tip or two.
