My husbands ex wife won't let him see their son. He did pay child support through the court until recently. She dropped child support on him. Then she sent a typed note from her stating to pay her child support through mail. I asked a lawyer and he said it was legal. He is planning on filing an action for visitation on her. She hangs up on him every time he tries to call her to see if he can see him. In their divorce papers it states that visitation is of her discretion. So what else can he do to see his son? He has just as much right to him as she does, right?

He should head back to court to modify the visitation order to establish a set schedule. He should be documenting all his attempts at visitation.

If there is an order for support, then he should continue to pay it, but keep records, such as cancelled checks. I don't understand what you mean by this: "She dropped child support on him." If the support was ordered at the time of the divorce, then perhaps she just closed the case at the agency. I'm sure he's still responsible for paying it.
