if the non custodial parent has not maintained in contact with his son for the past 4 months and is wanting to pick up his son for the christmas break without notice and we reside 100 miles apart or more does he have the right to pick him up... we havent heard from him by phone or letter and had made arrangements for the holidays then calls 10 days before christmas asking when and where he is to pick up our son. i need to know if i have a chance to beat him if we go to court. or what are the consequences we are looking at... he has always send us a letter to prepare for his arrival and arrange our plans accordingly as we have to pick up my son where his dad resides. what should i do.

You would be wise to OBEY the court order.

If you disobey the court order, he could make trouble for you.

You could always try to go to court and be herad.

But, I don't think youy'll be heard before the holidays.

If you don't get a hearing, obey the existing court order.
 
Agreed...obey the order. If you don't get a hearing before he comes, then you need to let him pick up your son.

It's unfortunate he's absentee for 4 months, but you can't alter your possession order because of it...you have to do it in court.

He needs to get his act together and stay involved with his son...that's the biggest issue in all of this.
