I want my son to stay with his dad for a night but because of daddy's girlfriend i don't agree due to my son is 3 with autism and needs not to be forced to call her mommy. As she tends to try and get him todo that. If his dad were to sign a paper stating when he would be home and where he would be dropped off is that sufficient enough to make him return my child and press kidnapping charges if he doesn't follow thru?

You won't get anywhere with the kidnapping argument. It simply is not kidnapping regardless of what dad might sign.
It sounds like you do not have court ordered visitation? If you do not have an order then either you or dad can change the rules as you go along and completely frustrate each other.
Perhaps before you allow the overnight visit you should get an order that specifies the terms of visitation.
