Shoplifting, Larceny, Robbery, Theft VOP petit larceny from 11yrs ago

My husband was walking thru the train in nyc on his way to work when he got stopped by the police & when they ran his name they saw he had warrants from a misdermeanor petit larceny charge from 11yrs ago. This is the 1st time we've heard about this & he's had his name ran thru the system a couple of times between 11yrs ago & now but nothing has ever popped up. It shows as if when he got out he ran to MD but he was actually turning himself in for a different case. He hasn't gotten in any trouble in a long time. What are his chances of him doing jail time for this? Do you think they will actually drop it?
 
Sure, ask for a lawyer, if he can't afford one.

Explain the situation.

Present any proof he might have, but this puppy will be DOA.

He'll never do any jail time.

Just plead not guilty.

Most likely there are no witnesses that can be found 11 years later.
 
Yep.. no worries. The chances of getting all the right people together to proceed with that case after 11 years are slim to none.
It was petty and long since forgotten by everyone but the records department. As long as he doesn't take some sort of kooky plea he will be fine.
 
I'm sorry, I forgot to mention that he did 30days for the larceny charge & was supposed to do 3yrs probation & thats whats actually popping up. VOP on the larceny charge but he says he never got any paperwork or anything saying he had to do probation thats why he left to MD & turned himself in. We keep hearing that you always get jail time for Violation of Probation. Is that true even tho this case is sooo old?

It is a possibility.

But, after 11 years, I doubt the probation officer still works there.
They'll have trouble revoking him without witnesses.

Wait until he speaks with his lawyer.
He should say that his PO told him he was released from probation for successfully completing all the requirements.
 
I agree. Its small time theft. I doubt anything will happen.
I hope so because I would be sooo upset if he does jail time for something so small & 11yrs old. & to think it all started with him just walking thru the train on his way to work.

Law enforcement is like fishing, troll long enough and eventually you'll hook something you don't have to throw back.
 
Okay so the charge is so bogus and old that they can't find any info & instead of releasing him they gave him a new court date for tues the 20th. Does that mean they might drop it?

They probably don't want to drop it.

They'll be looking for information to make it stick.

They won't find any.

Yes, they'll kick the charge after they discover they have no way to keep it alive.

:D:DI hired him a lawyer last week who was great (Alexander Sanchez in the Bronx). I got a lot of character witness statements from EVERYONE from his job & family. The lawyer went extra early & presented them to the court & they dropped all charges.
