Waiter contaminating customer's food.

If a waiter spit or urinated in a customer's food, what could be done to the waiter and the restaurant, civilly and criminally?

I live in Texas. What is the name of this crime? How severe is it?

A friend of mine is upset because he went to a restaurant, and the person who prepared his food supposedly urinated in it because he was an old enemy who still held a grudge. My friend later found out about this because another waiter witnessed this and told him about it. I'm not sure what my friend plans on doing, but out of curiosity I was wondering what could be done.

I do not know what the section would be in Texas, but your friend and the witness need to contact the police where it happened and report it.
